1. Acceptance of Terms

By accessing or using the Hostickets platform ("Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the Terms, you may not access or use the Service.

2. User Accounts

When you create an account with Hostickets, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate suspension or termination of your account. You are responsible for safeguarding your password and for all activities that occur under your account.

3. Event Listings and Ticket Sales

Hostickets provides a digital platform for event organizers ("Organizers") to create, manage, and sell tickets to attendees ("Attendees"). Hostickets is not the creator, organizer, or owner of the events listed on the Service.

  • For Attendees: When you purchase a ticket, you are entering into a direct agreement with the Organizer. Each ticket is subject to the policies, rules, and refund terms set by the specific Organizer and/or venue.
  • For Organizers: You are solely responsible for the accuracy of your event listings, pricing, and compliance with all applicable laws and regulations in South Africa. Refund and cancellation policies must be clearly displayed on your event page.

4. Payments, Refunds, and Cancellations

All payments made through Hostickets are securely processed by our payment gateway partner, Paystack. Refunds are determined by the Organizer’s stated policy. Hostickets will only process refunds in cases where an Organizer has authorized us to do so, such as an event cancellation. In such cases, refunds will be issued in accordance with the Organizer’s instructions and applicable consumer protection laws in South Africa.

5. Limitation of Liability

To the maximum extent permitted by law, Hostickets and its parent company, Makhina Group (Pty) Ltd, including their directors, employees, and partners, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law provisions.

7. Changes to Terms

Hostickets reserves the right, at its sole discretion, to update or replace these Terms at any time. Material changes will be communicated via email or platform notifications at least 30 days prior to new terms taking effect.

8. Event Pricing and Plans

This section outlines the fee structure and different plans available for publishing and selling tickets on our platform.

Core Fees Explained

A Paystack Fee is a transaction fee applied to every single ticket sale. This fee is charged by our payment gateway, Paystack, and is always deducted from the ticket revenue, regardless of your chosen plan.

The Platform Fee is an additional fee charged by our platform. This fee is only applied to tickets sold after a specified free ticket limit has been reached, depending on your plan.

Starter Plan

The Starter Plan is designed for first-time organizers and can only be used once.

  • Free Ticket Limit: You can sell up to 50 tickets without paying any additional platform fees.
  • Ticket Overage: If you sell over the 50-ticket limit (from the 51st ticket onwards), the platform fee will be applied to each additional ticket.
  • Ticket Cap: This plan has a maximum limit of **200 allowed tickets**.

Pay-as-you-go Plan

This plan is for users who want to pay a one-time publishing fee each time they create a new event.

  • Publishing Fee: You pay an upfront fee for each event you wish to publish.
  • Free Ticket Limit: You can sell up to **500 tickets** per event before any platform fees are applied.
  • Ticket Overage: For tickets sold over the 500-ticket limit, the platform fee will be deducted in addition to the Paystack fee.
  • Ticket Cap: This plan has a maximum limit of **1000 allowed tickets** per event.

Yearly Subscription Plans

Our Yearly Subscription Plans are ideal for frequent event organizers. Users pay a single, upfront subscription fee for the entire year.

  • Publishing: Unlike the Pay-as-you-go plan, these plans allow you to publish a set number of events per year without any additional publishing fees.
  • Free Ticket Limits: Each subscription tier offers a higher, specified number of tickets that you can sell without incurring platform fees.
  • Ticket Overage: Once you exceed your plan's ticket limit, platform fees will be applied to all subsequent tickets sold within that event.
  • Ticket Caps: The total number of allowed tickets per event is significantly higher on these plans compared to our other offerings.
